These Terms of Use ("Terms") govern your access to and use of the Penji Weather AI mobile application, website, and related services (collectively, the "Service") provided by Simsim Technology LLC ("we," "us," or "our"). By using the Service, you agree to these Terms.
Eligibility
You must be able to form a binding contract to use the Service. If you are under 18, you may use the Service only with permission from a parent or legal guardian.
The Service
Penji Weather AI provides weather information, forecasts, alerts, optional live radar, AI-generated guidance, and community-submitted weather reports. The Service is for personal, non-commercial use unless we agree otherwise in writing.
Not emergency or professional advice
Weather data, AI responses, and community reports may be delayed, incomplete, or inaccurate. The Service is not a substitute for official government warnings, emergency alerts, or professional safety advice. Always follow local authorities during severe weather.
AI features
Penji AI generates automated responses based on available weather context. AI output may contain errors. You are responsible for your decisions regarding travel, outdoor activities, health, and safety.
Community reports
When you submit a mismatch report, you agree that:
- Your report reflects your honest observation to the best of your knowledge
- You will not submit false, misleading, harassing, or abusive reports
- We may display aggregated reports to other users in your area
- We may remove reports or restrict accounts that abuse the feature
Accounts
You are responsible for activity on your account and for keeping your sign-in credentials secure. You must provide accurate account information and notify us of unauthorized use.
Subscriptions and purchases
Some features, including Penji Pro, require a paid subscription or in-app purchase processed by Apple. Pricing, renewal, cancellation, and refunds are handled under Apple's App Store terms unless required otherwise by law. Acceptable use
You agree not to:
- Use the Service unlawfully or to harm others
- Attempt to reverse engineer, scrape, overload, or disrupt the Service
- Circumvent usage limits, paywalls, or security controls
- Submit spam, malware, or misleading community reports
- Use the Service to provide competing weather data services at scale without permission
Intellectual property
The Service, including Penji branding, software, design, and content we provide, is owned by us or our licensors and is protected by applicable intellectual property laws. You receive a limited, non-exclusive, revocable license to use the Service for personal use.
Third-party content and links
Weather, radar, and map data may come from third parties. Their trademarks and data remain their property. We are not responsible for third-party websites or services linked from the Service.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMSIM TECHNOLOGY LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
Indemnification
You agree to defend and indemnify us against claims arising from your misuse of the Service, your community reports, or your violation of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service or other users. You may delete your account in app settings.
Changes
We may update these Terms from time to time. Continued use after changes become effective means you accept the updated Terms. Material changes will be posted on this page.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles, except where mandatory consumer protections apply in your country of residence.
